LOS ANGELES, CA (California Network) - The Supreme Court has issued rulings in four cases. Here are their decisions.
On Affirmative Action:
The University of Texas may continue using race as a basis for admission. The decision was 4-3 with Justice Elena Kagan recusing herself from the decision.
On Immigration:
President Obama has no power to shield 4 million illegal immigrants from deportation. He cannot also provide them with work permits unless Congress approves. The decision paves the way for deportations of millions to resume. The decision was a 4-4 tie, which leaves a Federal Appeals Court ruling from New Orleans in place.
On Drunk Driving Laws:
States may not criminalize a refusal to take drunk driving blood alcohol test. Police will now need a warrant before forcing a suspect to submit to a blood alcohol test. Police will not need a warrant for breath tests, since the court finds such tests to be less intrusive. Unlike blood tests, breath tests don't pierce the skin or provide the government with a biological sample.
Eleven states have laws that penalize for suspects who refuse a blood test. Those laws will now have to change.
On Repeat Offender Laws:
Federal prosecutors will find it more difficult to seek longer sentences against repeat offenders. The Supreme Court ruled 5-3 that courts are limited in how they can use prior convictions. Under the federal Armed Career Criminals Act, prosecutors have been increasing sentences for convicts. Courts may have to reduce some existing sentences.
