Couple plans to sue hospital, believing swap was intentional.

Following the reunion with their biological infant son, a Texas couple decided to pursue a lawsuit against the hospital and gynecologist responsible for swapping their son with another child.

MUNTINLUPA, PHILIPPINES (Catholic Online) - The Daily Mail reported that the U.S.-citizen missionary couple vowed to bring the culprit to justice while the gynecologist continues to insist he did not violate any laws.

"We don't just want our baby, we want those responsible to pay for what happened," said the couple.

Gynecologist Dr. Alejandro Guidos was already arrested but his lawyer said that he would not plead guilty of the "blunder" accused of him by Mercedes "Mercy" Casanellas and her husband, British-born Richard Cushworth.

The couple, residents of Dallas, Texas, made headlines after claiming that the child they brought home underwent a DNA test that confirmed the boy wasn't theirs.

The parents immediately demanded help to find their baby, who was fair-skinned. They worried his light skin could have led his kidnappers to sell him to human traffickers.

Since then, baby Moses was returned to them following an emotional special court hearing and the couple still believes the swap was intentional. They demanded San Salvador's Centro Gynaecologico hospital and Dr. Guidos to explain what really happened.

"As long as the hospital doesn't explain what happened, I will continue to believe that it is something sinister. We want to find out what has happened, and if there are people to blame, that they are made to answer for what happened. Today we want to find the culprits," Casanellas' lawyer announced, as reported by Diario 1.

Aside from the "mistake," a source said that Casanellas wanted to clear her name after some reports stated she orchestrated the swap herself to win compensation from the hospital and knew the mother of Jacob, the infant they brought home.

"I want to set a precedent in this country that no woman should ever have to go through what I went through," said Casanellas upon learning of the accusations against her.

Sources claim the other couple was shocked when they learned the baby they brought home wasn't theirs. Both parties reportedly wept as the swap was made, particularly because they had each bonded deeply with the babies they believed were theirs.

Miguel Flores, lawyer for Dr. Guidos, said his client was still being prosecuted despite "everyone" on the case believed the swap was an accident. He claimed innocence, received bail and continues to work at the hospital. The doctor did not plead guilty and he believes the charges will be dropped.

"I am perfectly calm. I have nothing to prove. I am innocent and the tests proved that so we move on," said Dr. Guidos.
