If the killer is convicted, he will see the death penalty.

Gargi Datta, ex-girlfriend to James Holmes, the Dark Night theater killer, initially thought her ex-boyfriend was only joking or experiencing some philosophical musings during their Google chat conversations where he talked about "killing other people." However, after she showed their exchange to a friend, both concluded that Holmes needed to seek psychiatric therapy.

MUNTINLUPA, PHILIPPINES (Catholic Online) - Datta claims it wasn't until then that she felt maybe Holmes was being serious about his fantasies of killing people. As it turns out, Holmes had planned to conduct mass murder and was already collecting weapons at that time.

After he opened fire in a suburban Denver cinema during a midnight showing of "The Dark Knight Rises," killing 12 and leaving about 70 others injured, the 27-year-old neuroscience graduate student will face the death penalty if convicted.

Holmes has pleaded not guilty, due to insanity.

From testimonies by two court-appointed psychiatrists, it was determined that Holmes suffers from a serious mental illness, which under the Colorado Law falls under the definition of insanity. However, they also stated that the suspect knew right from wrong during the time he initiated the shooting rampage in 2012.

Doctors claim Holmes suffered a serious psychological breakdown in jail about four months after he was arrested.

According to The Daily Mail, Holmes, a California native, was illustrated by prosecutors as a "calculating killer," saying he had written about his "obsession to kill" in a journal since he was just a kid.

Datta explained that he appeared calm, although disappointed, when she broke up with him. Holmes never did show signs of violence during the time they were together.
