Judge believes the ad creators 'are still entitled to First Amendment protection.'

After being the center of a legal debate, posters with the statement, "Killing Jews is Worship that draws us close to Allah" are going to soon be seen plastered on New York City buses and subways due to the victory of American Freedom Defense Initiative (AFDI) against the Metropolitan Transportation Authority (MTA).

People from NYC are known to have a wide tolerance of controversial advertisements, however, the agency argued that AFDI's take on the issue isn't on point.

The MTA argued that the ads call out for violence against Jews. The U.S. District Judge, John Koeltl dismissed the arguments, stating it overestimates the potential impacts while underestimating the tolerant quality of the people of New York.

"Moreover, there is no evidence that seeing one of these advertisements on the back of a bus would be sufficient to trigger a violent reaction. Therefore, these ads - offensive as they may be - are still entitled to First Amendment protection," he ruled.

The judge also wrote that the AFDI has admitted that the ads are to parody the 'My Jihad' campaign of the Council of American-Islamic Relations (CAIR), as well as to critisize the radical Islam and Hamas.

The MTA is firm on their stand that the ads are feared to incite violence as the words, although allegedly with accompanying disclaimers.

"What matters is not AFDI's intent, but how the ad would be interpreted," wrote the MTA Security Director Raymond Diaz, citing that the parodied CAIR posters were not seen in NYC.

On the other hand, the AFDI President Pamella Geller expressed that it was a victory for liberty and free speech.
