Pronounced dead at gallows, man later discovered breathing

He was executed - survived, and will not be retried. A 37-year-old convicted drug trafficker known only as Alireza M was sentenced to be hung by the neck until dead by an Iranian court. Summarily executed, he was discovered breathing the next day in the morgue. Iranian Justice Minister Mostafa Pour-Mohammadi says the man will not be retried or executed a second time.

LOS ANGELES, CA (Catholic Online) - Calls from both within Iran along with appeals from international rights groups have been alerted to the most unusual case. "The convict who survived (the death penalty) will not be executed again," Pour-Mohammadi said this week. "After putting much effort to prevent the second execution of this convict, we have received a positive response," he added.

Pour-Mohammadi implied that a second execution would be damaging for Iran's image. "If he survives, it is not expedient to hang him again," the minister said.

In Iran, all judicial affairs and decisions in the Islamic republic rest with the judiciary, which constitutionally operates independently from the government.

Pronounced dead earlier this month by the attending doctor after hanging for 12 minutes from a noose suspended from a crane at a jail in northeast Iran, Alireza M survived the ordeal. Staff at the mortuary in the city of Bojnourd later discovered he was still breathing. Media later reported that he had fallen into a coma.

Jurists debate over the need for a second execution. A petition signed by jurists and attorneys was sent to judiciary chief Ayatollah Sadeq Larijani, appealing for a stay in the exceptional case. Amnesty International also called for a stay of execution for Alireza M.

Iran has one of the highest rates of execution in the world, with more than 500 cases last year and some 508 executions so far this year. Tehran argues that the death penalty is essential to maintain law and order, and that it is applied only after exhaustive judicial proceedings.

Murder, rape, armed robbery, drug trafficking and adultery are among the crimes punishable by death in Iran.

It's estimated that around 200 people have been put to death in Iran since its new president Hassan Rouhani came to power in June.
