Homosexual Activists File Federal Lawsuit in Nevada to Oppose Marriage

Marriage is the preeminent and the most fundamental of all human social institutions.

The Trojan Horse of Domestic Partnership and Civil Union legislation is a cog in a cultural revolutionary strategy. The case in Nevada is the first time that Lambda Legal has used a federal court to attack a State Constitutional amendment which defended marriage as between a man and a woman. They asked the Court to declare it unconstitutional and enjoin anyone from disagreeing. To limit marriage to heterosexual couples is not discriminatory now, nor has it ever been. Homosexual couples cannot bring into existence what marriage intends by its very definition.

LAS VEGAS, NV (Catholic Online) - We are in the midst of a Cultural Revolution in the West. I know  some of my readers, especially my detractors, will call such a claim alarmist and an overreach. However, the writing is on the wall and we all better read it and act. 

The foundation of Western Civilization is marriage between one man and one woman and the family and society founded upon it. The truth about marriage is not simply a "religious" construct.  The Natural Law reveals - and the cross cultural history of civilization affirms - that marriage is between one man and one woman, open to children and intended for life.

Marriage is the foundation for the family which is the privileged place for the formation of virtue and character in children, our future citizens. The family is the first society, first economy, first school, first civilizing and mediating institution and first government.

Marriage has been understood as arising out of the consent between one man and one woman and intended for life. It has been given a privileged and protected legal and social status, viewed as the primary civilizing institution constituted for the bearing and rearing of children. Within the family they can best be nurtured, loved, taught and prepared for citizenship and life in broader communities.

This understanding of marriage has long been understood in the West as revealed by the Natural Law. It was the basis of our organizing vision of society and informed our philosophy of governance. That included the place of subsidiarity, recognizing the family as the first government. Our educational system also recognized the family as the first school and parents as the first teachers.

We are experiencing a campaign to effectuate a radical change in our social order on all of these fronts. It is being done with verbal sophistication and utilizing a well funded legal strategy. Among the legal groups at the forefront of this Cultural Revolution is one called the "Lambda Legal Defense and Education Fund".

On Tuesday, Aril 10, 2012, Lawyers for the Lambda legal Defense Fund filed a Federal Lawsuit in the United States District Court asking for Declaratory and Injunctive Relief. The case is numbered 2:12-cv-00578 and styled, Sevcik & Baranovich, et al. v. Sandoval, et al.

This case is part of a National strategy to use the Courts to compel us to call what can't be a marriage to be one or face the punitive force of the Police Power of the State. The effort relies upon using the 14th amendment to the US Constitution, the "Equal Protection Clause", as a tool for enforcing a cultural revolutionary strategy. 

Referring to the eight homosexual partners who are the Plaintiffs the thirty page complaint argues, "They bring this action, pursuant to 42 U.S.C. § 1983, seeking declaratory and injunctive relief for the violation of their rights under the Fourteenth Amendment to the United States Constitution caused by their being denied the right to marry in the State of Nevada (the "State").

"The State has instead relegated these couples to the inferior and novel status of registered domestic partnerships, and has disrespected the marriages some of them have entered in other jurisdictions, because they are lesbians and gay men in same-sex relationships."

The thirty page complaint continues, "Civil marriage plays a unique role in society as the universally recognized and celebrated hallmark of a couple's commitment to build family life together. Plaintiffs have formed committed, enduring family bonds equally worthy of the respect afforded by the State to different-sex couples through access to the status of marriage."

"Yet the State, without any adequate justification, has deprived lesbian and gay Nevadans of the right to marry, or to have their valid marriages from other jurisdictions recognized as marriages, based solely on their sexual orientation and sex. This discrimination (referred to herein as the State's "marriage ban") is enshrined both in Nevada statutes, and in article 1, section 21 of the Nevada Constitution, which limits marriage solely to couples composed of "a male and female."

    Judy: You mentioned my grandson. I am happy to report to all my friends that my grandson is finally home safe and sound and enjoying his new daughter. She is quite happy in his arms. It's almost as if she really knows who he is already. He will be home for awhile. don't know for how long. Since, he re-enlisted AGAIN, (I was hoping he wouldn't) he will be deployed again. I hope it's not for awhile. Please keep him in your prayers. Love ya all. God bless.

    Rob: Thank you for your response. And yes, I do most wholeheartedly agree we should live in the present moment. The present moment is all any of us have, and it is blessed gift of life indeed. Just so you understand where I am coming from in regard to history, Theresa H. shared a superb post on, "Obama's Set the Catholic Church on Fire" or something to that effect. It is absolutely marvelous and articulates History both Near and Far that hits upon today. Foresight. I would like to hear your opinion on this, because although it deals w/the distant past of 2,000 years, a past from 1887, and a past as recent as the Obama and McCain election, they nonetheless all coincide. And seem, to coincide with History. Case in point, WWI and WWII of which you speak. It rears its head as well. Do read it. And speaking of WWI and WWII, I will say, certainly there are not as many w/the character and strength of our fathers and grandfathers. I believe, it perhaps might be of Theresa H.post, where Prof. Tyler mentions just that very particular part that they play in a democratic society. See if recognize them, and see if you agree. But I do think, using the Star War analogy, that there are a few still left w/the Force. God. Persons like JoAnn's grandson is one. People that avoid Evil and do Good, are another. I like to think of a lot of people...like the early Christians who were the minority...Catholic Charities in Big Government, in today's moment. I like to think as a lot of us on this board as such people. Do not you consider yourself as one? I get what you are saying though. And that my friend was a past time, one of History, that is no more. But hopefully we as off-spring do measure up...just a bit different. Some for the worse, some for the better. If Obama was for Equality as much as he says he is, he surely would not be affronting the Catholic Church. As far as scrutiny on the next president, if there is a new one? You bet! The good ole media who has always seen to it will see to it...Even more so, because it is a Liberal Media who supports Obama. These three mishaps we have seen in the government branches that I mentioned before were all tried to be hushed up. And it would not surprise me if there were more we do not even know about. That aside, who is perfect? But to coin the phrase of a little child, "Obamas' made too many bo-boos". Blessings....

    Rob: Obama was elected because 95% of the black population voted for him simply because he was black. At the time he was elected, I was still in the work force. The company I worked for was a very non biased company and 65% of the people were black. Everyone of them except for 3 said they were voting for Obama because he was black. Period!!! Latinos voted for him because they thought they were going to get amnesty. Independents voted for him because of Bush's spending. Democrats voted for him just because he was a Democrat. AND, "Progressives" voted for him because he had the same ideology of where they all wanted to take this country. You have to remember, 48% of America knew who this man really was and didn't want any part of his Marxist/Socialism policies. Sooo, Rob, when you talk about America voting for Obama, please do not include the 48% who knew better. If my memory serves me right, I think I remember the Republicans being called the party of NO. They didn't want any part of his ideology either. Thank God. God bless.

    Rob, "We are all just the sheep being led to the slaughter". No truer words spoken. I see more people being engaged in the process. When the Marxist Democrat Party rammed Obamacare down America's throat, millions of us read The Bill. We saw where abortion and birth control is included as a mandate. It finally took Obama enforcing Obamacare to wake up the Bishops. Now they are doing what they should have done 3 yrs ago. When Obama gave the American people the one finger solute over the bankrupting "Stimulus Bill", the Tea Party was formed. People are finally waking up and getting active. I hope the Catholic Church comes alive like the Tea Party.

    Vance, whatever his past associations are it does not change the fact that he was elected President and nor do these associations excuse the antics of our government these past 3 years. But the reason that this drum has been beat constantly is that we've lost sight that these guys are sent to do work. I think the voting public is just as caught up with the pursuit of power as the politicians are. That's why when the dust settles we can't come together as Americans anymore. In times past the people didn't have to endure a 24 hours news cycle or the constant ramblinging of talk redio, the internet etc. They could fight the good fight and then work to get things done. I think today our minds have been poisoned by the contant barrage of negativity on both sides. The result, a divided country. Political campaigning almost 24/7 and unprecedented amounts of money flowing to people. I do have to hand it to these folks though, they have managed to distract 315 million people as to the activities and antics of 545. What these guys have been able to pull over on the American people just boggles the mind. What Hitler was able to do to Germany our own politicians have done to us fiscally and then some. We are all just the sheep being led to slaughter.

    Judy, you are spot on about examining Counterfeit President Barry Soetoro's past. We know about Communist Terrorist Weather Underground Bill Ayers and his wife Bernardine Dorn. New information reveals that the Parents of Bill Ayers supported Barry when he was in college. We all know the Barry's father was a Communist Activist. Saul Alinsky is one of his mentors among others. Yes indeed it is important that we pay attention to Barry's past because this tells us where he is coming from and where he wants to take this country. It's abundantly clear where he wants to take this country - Over the cliff.

    Homosexuality not only offends God but it defies natural law. Homosexuality has no valid biological support whatsoever.

    Judy, I appreciate your advice about the past. I am not suggesting we ignore history, but we definitely cannot afford to ignore the present moment because that is all we have. Again, Obama's past associations and worldview is instructive, but it did not change the election results and it's absolutely no excuse for the entire DC aparatus to basically shutdown and do nothing. As they have played politics, our fortune as a country has just been getting worse and they all own that. My point in stating the "agenda" I've lived with for forty years was not to state I have no knowledge of history, quite the contrary, but to point out that after four decades the team I keep voting for does nothing to stem the tide. We arrived at this point of a sick status quo with politicians who have lost their ability to govern and deal with the problems of our time. They somehow lost the ability to be statesmen and instead leave bad laws in place because it's good for the campaign and their own personal enrichment. And Americans for the most part have lost their ability to understand our issues. Take for instance the $5 trillion dollar number that get's thrown around. To act as if we are shocked basically admits our stupidity and complicity in the problem. When is the last time you read an article that picked apart the number? Sure, we want to hang it around the President's neck, but what we as American's don't seem to be too interested in is understanding it. We do not want to talk about unfunded wars, unfunded prescription drug benefits, welfare and defense spending gone wild and deficit causing tax cuts that aren't working. Our present moment has become some sick 2 minute political commerical with just enough truth to give us something to talk about, but completely devoid of any analysis. We are so busy going after the other side that we stopped looking at the big picture. One thing I am absolutely convinced of is that the character and strength the citizens had, that got us through WWI & WWII, does not seem to be with us any longer. I firmly believe that generation would have run the entire DC aparatus out of town if they gave tax cuts to the wealthy, sent everyone a $600 dollar rebate check and asked nothing of the American people while our youth went to war, never mind borrowing from an enemy to finance it. And yet today, sacrifice like that seem to be lost to us. Maybe Obama will be run out in November. I love our system of government that allows us the opportunity to hold our leaders accountable as it ensures that no matter how bad a leader is, we can always adjust. But what I am dying to know is whether or not this same level of scrutiny will be applied to the next President. Will he be held to the same standards? Do we care about the party or the country? I guess we'll soon see.

    Rob, "Obama and his Politicians didn't get anything done"??? Where have you been these last 3 years?? Obama, Reid, and Pelosi "Socialized" our nations health care, He socialized General Motors and Citibank. Obama scrapped our Space Program. He stopped all oil drilling in the Gulf of Mexico and parts of Alaska and cut a 1/3 of the Coal Industry. Obama, Reid, and Pelosi Amended the Constitution of the United States. Catholic Church and Cardinal Dolan anyone?? Obama, Reid, and Pelosi Bankrupted our country. They are Fast-Tracking the complete collapse of Social Security and Medicare. Obama's 648 new EPA regulations are successfully running businesses out of the country or out of business. He has expanded the numbers of "The Poor" to 88 MILLION and growing. 50 MILLION people are now on Food Stamps. Obama has been a busy man. Everything is going exactly as he planned.

    Rob: Methinks you need to enter unto your sanctuary. And Perhaps read or watch movies= Excellent Historical ones of WWI AND WWII. What caused them and what went on in between to understand where some of us come from. You do not know why Winston Churchill was a great man. Why it was such an insult to our country for Obama to send it back. We can only pray that a President will do his job and not be tempted and consumed by power. None of us are God. I can name sooooo many things this president has done, negatively it would take a page...not to mention his lack of morals or character. Remember you learned NOT to Keep Bad Company as a child? Not to hang w/those of bad morals or character? You surely don't want your daughters to. That is the point JoAnn was making. Obama now has 3 Dept. of the Government in Scandal. As far as the GSA, he was warned over a year ago to get it in order and have accountability. He did not. That was his Responsibility. Fast and Furious another Branch. Soylandra (spell it?) another Branch. Three Branches of Government...all 3 Hearings had people claiming the 5th Amendment to protect their fearless? leader. And we are not even talking PP or Abortion. My youngest son, that will be pinned Lt. Colonel, is a year older than you. The other two, a son and daughter are older. All 3 are different. And of course I Love all of them and my grandchildren. I guess that's why I feel a bit friendly and momish to you. Sorry. That's me! Keep on the path...Easter Blessings..
