And all Christian judges (of any denomination) should recuse themselves from any case that has to do with religion.
What a specious argument! Being lawyers, presumably you know this, but you make it anyway.

Wow, does this guy work for Fox news also? This is a BLATANTLY false accusation. I have been carefully watching the entire Prop 8 proceedings and had this happened you would have heard about it long before any question of this guy's sexuality EVER came up! The reason you didn't hear about it until now is that it DIDN'T HAPPEN! I implore you to prove this happened by presenting EVIDENCE. Evidence is what the Prop 8 supporters failed to present during the trial and what will be the REAL reason they lose. But maybe you people already sense this and are looking for anybody and anything to blame but yourselves. Pathetic! And you call yourselves Christians???!!!
I am not sure why someone should not be allowed to preside over a case about prop. 8 just because they are homosexual. If it were to go to the supreme court should Scalia recuse himself because he is catholic and the catholic church does not believe in gay marriage? No because it is a matter of law.

That's such a horrible argument -- being gay itself doesn't "explain" anything. A straight judge could be accused of the bias in the other way, and indeed cases go on all the time where a judge might have some characteristic in common with people in cases. Are Christians all of a sudden not allowed to judge in Christian cases?
That said, I don't believe there was any major unfairness. There already has been a history of anti-gay violence and sentiment (not to mention law), and if gays are willing to show themselves in court, the anti-gays should be, too.
You people are crazy. The same said of this judge could be said for any judges who practice the heterosexual lifestyle and participate on this issue.
When this case is appealed to US Supreme Court, will Liberty Counsel be writing another editorial, demanding that the six Catholic heterosexuals on the Court similarly recuse themselves due to their "personal biases and alleged lifestyle choices"?
